Trading conditions
Introductory provisions
Mentioned general trading conditions (further mentioned as GTC) govern mutual obligation relations by supplies from the Wjenzek co., identification No. 10627278 (further mentioned as " a supplier") to his customers.Order
- Orders of the goods can be made in writing (by letter, fax, e-mail) or by phone.
- Every received order must include following:
- Name and surname
- Company name, its Identification No., Tax Identification No.
- Phone/fax/e-mail connection
- Clear determination of the ordered product, its required amount and a date of delivery
- Required way of goods delivery/takeover and accurate place of delivery/takeover.
- If the customer wishes by ordering, supplier can send him a written order confirmation.
- Any order change within its process is possible, if both sides agree and supplier needs to confirm this change to the customer in writing.
- Avoidance of a confirm order is possible only by mutual consent
- By sending an order to a supplier it is assumed, that a customer became acquainted with these GTC and agrees.
Terms of delivery
- Term of delivery runs from a date of order acceptance by a supplier and ends by goods transfer to a carrier.
- Unless provided otherwise, the standard deadline is supposed to be sellerś 5 working days by the order acceptance.
- Provided a supplier is not able to meet the agreed term of delivery,he is obligated to inform the customer without delay and arrange backup term of the performance with him. In case the customer disagrees, he has a right to withdraw from contract, however no claim for damages comes up.
Price
- Unless provided otherwise, the price originates in pricelist,which is valid in the order obtaining period.
- The prices are mentioned incl. VAT in the pricelist.
- Possible discounts or quantity discount are matter of a particular agreement between a supplier and a customer or a supplier and a reseller (a specialized shop with car accessories etc.).
Terms of payment
- Payment is based on an invoice/tax document issued on the day of goods dispatch. This invoice is in case of a payment spot enclosed to a given consignment, by a personal take-off a cash voucher is passed directly to the customer.
- Unless a customer has settled his debts towards a supplier, supplier can hold back his received orders.
Goods delivery
- Personally it is possible to withdraw goods from the company outlet in Velke Hostice, Opavska 189
- In other cases the services of the carrier wil be used.
Ownership and risks passing
- Unless provided otherwise, the goods ownership passes from the supplier to the customer by invoice paying.
- Unless provided otherwise, a liability for damage passes to the customer by the goods handover or by personal take-off.
Guarantees
- The supplier guarantees, that the goods delivered is manufacture and legal flawless and that it matches the declared specification.
- The supplier provides a guarantee for 3 years since the sales date referring to material defects and shop treatment.The supplier removes material flaws or the material defects and shop treatment during the guarantee period by repair or replacement of the faulty part for free (supplier decision).
- The gurantee does not relate to damages caused by incorrect usage, overloading, unskilled or careless transfer and manipulation, mistake by an assembly, that has not been performed according to the manual.
- The gurantee does not relate to damages caused by accidents, illegal driving, faults or discrepancies of the vehicle, on which this product was mounted, or by undersecured loading.
- Repair or replacement of the damaged Wjenzek product under guarantee is an dealer´s obligation. All subsequent and accidental damages are not included in the guarantee. By subsequent vehicle, load damage of the user or the other person and property damage does not relate to.
Claims
- Defective goods can be claimed only when the guarantee relates to it, when the product is bought by the supplier and if the claim application proceeded according those GTC.
- The customer is obliged to check the consignment by takeover and in case of noticing any of the outer damage or possible incompleteness he shall inform the supplier within 24 hours since the takeover.
The customer can set up a claim for the goods for:- apparent defects – within 1 week since the dispatch at the latest
- invisible defects – anytime during the guarantee period
- The claim needs to be set up in writing (incl. e-mail) only at the purchase place.
- The claim must include:
- name of the claimed product
- description of the ascertained fault
- circumstances of its origin or findings
- invoice No. and a copy of the confirmed guarantee card
- name and contact on an authorized person, that can discuss a claim
- the claimed product must be complete when returning to a repair or an exchange
- If the claim is acknowledged as warrantable, the customer can require following:
- free defect removing in case the default is removable or a discount corresponding to the ascertained defect
- new substitute consignment or a money-back to full extent, provided the fault is unrecoverable
- In case of a justified claim all expences connected with returning of the defective goods and sending the repaired or exchanged goods back to the customer are covered by the supplier.
- The claim expires after the guarantee period.
Final regulation
In all cases holds the present legislative of the Czech Republic and the place of delivery and the court seat is in Opava (seat of the supplier).
